Terms of Service

1. Agreement

By placing an order you agree to these Terms of Service in full. You must be 18 or older to use our services. Continued use of our website following any updates to these terms constitutes acceptance of the revised terms.

2. Our Services

Boca Totes provides short-term rental of reusable plastic moving totes, rolling dollies, and related moving supplies with delivery and pickup throughout Palm Beach and Broward Counties, Florida. We reserve the right to refuse service, modify, suspend, or discontinue any service at any time without prior notice.

3. Rental Period

One week equals seven (7) consecutive days from the confirmed delivery date. Equipment kept past the agreed return date without a prior written extension incurs a late fee equal to $1.50 per tote per week or the prorated weekly package charge — whichever is greater, charged to the card on file until all equipment is returned. If equipment is not returned or an extension arranged within 30 days of the return date, Boca Totes will treat the equipment as purchased and charge full replacement value to the card on file.

4. Pricing & Payment

All prices are in U.S. dollars and subject to change. By booking you authorize Boca Totes to charge your payment method for all amounts due, including extension fees, late fees, failed-attempt fees, damage charges, and cancellation fees. Payment is collected at booking confirmation.

5. Delivery & Pickup

Each order includes one (1) delivery and one (1) pickup. A person 18 or older must be present at both. For multi-story buildings requiring a stair carry, a $10/flight fee applies. Multiple orders to the same address do not qualify for additional complimentary trips.

6. Failed Delivery or Pickup Attempts

Boca Totes coordinates all deliveries and pickups in advance. If no authorized person is present within 15 minutes of the confirmed time, a $25 failed-attempt fee applies to cover driver wages, fuel, tolls, and time. A new attempt must be rescheduled and may extend the rental period.

7. Service Area & Out-of-Area Fees

Standard service covers Palm Beach and Broward Counties, FL. Out-of-area deliveries may incur an additional fee. You will always be notified and must approve any out-of-area charge in writing before it is applied.

8. Damaged or Lost Equipment

Equipment returned damaged or not returned will be charged at the following replacement rates:

You will be notified before any damage charge is applied and have 5 business days to dispute.

9. Equipment Return

You accept full personal responsibility for the safe and complete return of all rented equipment. Partial returns do not relieve you of responsibility for unreturned items. An authorized individual must be present at the pickup address at the agreed time.

10. Cancellation Policy

Free cancellation up to 48 hours before scheduled delivery. Cancellations within 48 hours: $50 fee. Cancellations after delivery: $99 restocking fee plus any rental days elapsed. All cancellations must be confirmed in writing via phone or email.

11. Text Message Communications

By providing your mobile number you consent to receive SMS/MMS order and delivery updates from Boca Totes. Standard carrier rates may apply. Reply STOP to opt out at any time. Consent is not required to make a purchase.

12. Limitation of Liability

Boca Totes is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or equipment. Our total liability for any claim shall not exceed the total amount you paid for the specific rental order giving rise to that claim.

13. Privacy

Boca Totes does not sell or share your personal information for any reason unless there is a failure to pay for services rendered, in which case we may share necessary information with collection or legal counsel solely to recover outstanding amounts. For full details see our Privacy Policy.

14. Service Interruptions

Boca Totes may temporarily suspend operations due to natural disasters, declared emergencies, or other circumstances beyond our reasonable control. Affected orders will be rescheduled as soon as practicable.

15. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes are subject to the exclusive jurisdiction of state and federal courts in Palm Beach County, Florida.
